More info:
- My entire website has been published in English to make it more accessible to anyone. I am not responsible for any misunderstanding caused by mistranslation or misinterpretation about anything written anywhere on this site.- These terms and the commissions page are subject to updates. I will always provide access to a changelog should it be necessary. The start and end dates of each commission will always be available in the completed commissions section of the queue page, which keeps a record of which version of the ToS applied during each commission.- Changes to these terms made during a commission in progress may or may not apply to it, depending on the case. Every rule ever created tells a story, after all.- When starting a commission, it is assumed that both the commissions page and the ToS have been fully read and agreed to.- These terms may be negotiated as needed.
Use
- My commissions and their conditions mentioned here are for personal, non-commercial use only. For commercial work, please contact me directly and we'll discuss details.- Any attempt to profit from my works will be considered commercial use and will require the corresponding extra payment for commercial commissions.- What I create cannot be used for anything related to AI, NFT, be edited, traced, monetized in any way, have its authorship claimed, or be posted by anyone other than me, unless you have my explicit consent.- When personal use involves displaying any of my works publicly in any way, such as using it as a profile picture somewhere or reposting it with my permission, you must credit me as the artist. The correct way to give credit being tagging any of my valid usernames that you know of, or this website.- You agree not to erase my signature from my works.- Everything described here applies to both completed projects and works in progress.
Work Process
- When contacting me for a commission, tell me your idea and ask any related questions you may have.- Upon accepting your commission, in addition to completing the form specified in the commissions page, I will ask you for details and reference images. The more specific you are, the better: shapes, colors, a space, brushes to use (I work on Clip Studio Paint and PaintTool SAI), stylization, size and resolution of the artwork, and anything you can think of. Every detail is welcome, as long as you're asking for something you know I can already do, and if not, just ask. I encourage you to even create your own composition proposal, even if it's just with stick figures, which would help a lot.- The responsibility for being as specific as possible with the details and providing references lies with the client. Failure to be specific with any requested detail will be considered as a request for creative freedom.- I'll ask you for a name so I know who to assign the commission to. This name will be displayed on my queue and on the social media platforms where I post my work when it is completed. It can be your username on a website, simply "anonymous," or anything else you prefer as long as it's nothing offensive.- I work with a queue and an estimated turnaround time that depends on the complexity of the project, my own available time to work on it, and the clarity of our communication. Normally I'd be done with a full render of a single character in a couple of weeks. I request your patience.- Any commission with a specific deadline will mean a higher cost.- Payment is upfront and divided into stages: sketch, color, render, as applicable. Payment for each stage is defined in advance too.- Work time begins after I receive your payment and when it's your turn in the queue. You can wait until that moment to pay if you want.- I accept priority requests, but it will mean a higher cost and will start only after any commission I'm currently working on is completed, unless the client for that one agrees to postpone it.- When I submit progress for review, I will not continue work until I receive a reply. If more than 14 days pass without a response, the project will be returned to the queue and any agreed-upon work time or deadline will no longer be valid. Deadlines and agreed-upon work times are paused if a reply isn't given during the first day of the progress being sent.- 2 reviews per stage. Reviews limited to correction. Illustrating an idea to visualize it before actually drawing it doesn't count toward this number or as a review, that's just normal conversation between us.- Free corrections are only available during the sketch stage. Corrections at later stages will mean a higher cost that will be defined by complexity.- Changing your mind about what you've asked for when I've already done it or going back to a stage that has already been completed, will be treated as a new request, restarting the process, unless I misunderstood what you asked for, so absolute clarity of detail is required, verbal or visual.- Once the artwork is finished, you will be asked for a delivery method if you haven't already. Email is preferred.
Rights
- It is your right to request updates on my work if you haven't received any within an agreed timeframe. Otherwise, your patience and understanding are requested.- In the event that I encounter any unforeseen circumstances that require changes to the agreed work times or deadlines for any reason, you will be informed as soon as possible. If these setbacks occur during a commission with a deadline, you have the right to demand a refund limited to the stage that was in progress: if you paid for a rendered piece but I could not continue beyond the final sketch, the refund will consist only of the extra payment added to the sketch by the coloring and rendering.- No refunds for changes of mind.- No refunds for completed stages.- No refunds for failure to respond to progress reviews after 14 days.- You can demand a refund for changes to agreed non-deadline work times only if I fail to send updates during those agreed times.- If someone requests a priority position on the queue, taking your already established turn, you will be notified and offered a refund if you had already paid. Refunds granted this way are also limited to what is established above if I had already been working on your commission.- You will be entitled to refunds with no reason only if I have to stop working on your commission for personal reasons, which I will notify to you.- All interaction must always be respectful, and any form of harassment or disrespect will result in immediate termination of my work as I see fit, without a right to a refund.- I reserve the right to charge extra for any detail or added complexity not listed on the commission form.- When the commission is declared completed for any reason, whether the work has been finished or not, I reserve the right to post it on my social media and portfolio, use it for merchandise and even continue working on it on my own if I so wish, unless otherwise agreed, which will mean an increased cost.- Even if we agree that I cannot post or use a work, everything stated in the Use section of my ToS still applies. Especially crediting me as the artist when personal use involves displaying any of my works publicly in any way by yourself.- I own the copyright to every work I do. This applies to the works themselves and my own creations, not to characters subject of fanart or creations made by other people.- I reserve the right to refuse any commission for any reason, without obligation to give explanations.
